- In the event that an inspection leads to violations, you will get a letter in the mail offering a settlement for a smaller amount. DO NOT automatically accept settlements. Although there are some violations that cannot be fought, based on our experience, defending the violations at a hearing will often result in a reduction of fines that is better than the settlement offer.
- When given the choice by the Judge if we want an inspector present, we often choose not to.
- Always be prepared. Bring all relevant evidence with you. If you think something will help your case, bring it!
- Read the violation report carefully. If an inspector writes a violation and uses the wrong section of the Code, that violation could be dismissed.
- After your inspection, you will receive a letter grade card and a GP card, you should post the GP card until you receive a decision from OATH.
- You are allowed to adjourn the hearing date a total of 3 times.
- After 2 adjournments, you can no longer keep the GP card up. You must post the grade card given to you during your last inspection. If your Grade is changed during the hearing you will receive your new grade, which you can then post.
- All fines must be paid within 30 days from the decision date.
- Hiring an Attorney will often lead to better results at the hearing.
- Hiring an Attorney is not expensive and you do not have to personally attend, which in the end will save you time and money.
