Effective January 24th, restaurants must make their toilet facilities available to all food delivery workers while picking up orders for delivery.
Designed to provide improved working conditions for food delivery workers, NYC’s new law requires that food service establishments provide restroom access to third-party delivery workers.
There are exceptions. A restaurant will not be required to provide access if:
- accessing the toilet facility would require a worker to walk through the establishment’s kitchen, food preparation area, storage area or utensil washing area” or
- accessing the facility “would create an obvious health and safety risk to the food delivery worker or to the establishment.”
